Cuddles Foundation is a non-government charitable organisation, registered under The Maharashtra Public Trusts Act with its registered office at Unit No. 5, 2nd floor, Brady Gladys Plaza, 1/447, Senapati Bapat Marg, Lower Parel, Mumbai – 400013  (Cuddles). We are committed to ensuring your privacy in accordance with applicable Indian law. 

Set out below is the privacy policy of Cuddles to be read in conjunction with the Terms and Conditions and any other agreement executed with you (the Privacy Policy).

This Privacy Policy explains our practices regarding the processing of your personal information as collected by Cuddles on or through the Cuddles website, the FoodHeals app, and any other platform used by Cuddles to offer and provide their services  to you, unless the application of this Privacy Policy is expressly excluded by reference or an alternate privacy policy has been made available for such platform (each a Platform). 

For the purposes of this Privacy Policy the references to ‘you’ shall mean any natural person whose data is being processed by Cuddles and shall include any donor/donor, beneficiary/patient, legal guardian, individual representative of corporate donor, individual representative of hospital, employees, individual representative of vendors, individual consultants, and nutritionists. 

This Privacy Policy is to be read in conjunction with the Terms and Conditions.

Scope and Terms of Privacy Policy

  1. You hereby provide your free and informed consent to the processing of your personal information by Cuddles as is set out in this Privacy Policy. 
  2. If you do not agree with the terms of this Privacy Policy, you are requested to immediately cease your access to and use of the Platform and the services as provided by Cuddles on the Platform.

What information does Cuddles Foundation collect?

  1. We collect and process your personal information only to the extent necessary to satisfy the purpose in relation to which you have provided us with your personal information. Accordingly, the nature of personal information we collect from or about you will vary depending on the purpose for which it is provided to us by you.
  2. If you are a donor on the Platform, we collect the following information from you 
    • First and Last name;
    • Donor address;
    • E-mail address;
    • Telephone number;
    • Nationality;
    • PAN card number or unique tax identification number; 
    • Passport details; and
    • Payment information.
  3. For each beneficiary of the nutrition and related programmes provided by Cuddles, we collect the following information from the lawful guardian(s) of each such beneficiary/patient: 
    • Full Name; 
    • Gender;
    • Mothers Name 
    • Town/District of Origin
    • Date of Birth
    • Preferred Language 
    • Details of the hospital at which the patient is receiving treatment;
    • Details of the patient’s diagnosis: Type of cancer, stage of cancer, type of treatment, relapse (if any), date on which chemotherapy was started and any other medical condition that the patient may suffer from;
    • Anthropometric measurements including patient’s height in centimeter, weight in kilograms, MUAC in centimeter; TSF in millimeter; body mass index; treatment phase to assess grade of malnutrition of the patient; 
    • Details of biochemical and clinical assessment of the patient and WHO calorie steps;
    • Dietary assessment including details and timings of food intake by the patient, route of food intake, food supplements;
    • Details of any medical side effects that the patient is facing;
    • Details of the nutritionist who is counselling the patient;
    • Other information including inter alia availability of any alternate source of ration, and availability of cooking facilities at their accommodation. 
    • Medical condition and history;
    • Data to measure health parameters at regular intervals;
    • Other data usually recorded by healthcare providers to cancer patients.
  4. From each lawful guardian of each beneficiary of the nutrition and related programmes provided by Cuddles, we collect the following information:
    • First and Last Name; 
    • Relationship with the beneficiary/patient; 
    • Contact number and Whatsapp Number of Guardian or any other relative; and
    • Monthly Income 
  5. In addition to the personal information that you submit to us, we automatically collect some information when you visit our Platform. This type of information is listed below:
    • Our web servers may collect certain information such as IP address, pages visited, time of visits, device IDs browser type, browser version, network service provider details and referring website;
    • Information retrieved from access to the device you use to access a Platform, including the location, microphone and audio on the device;
    • Cookies: Cookies are simple text files stored by your web browser that provide a method of distinguishing among donors and visitors to the Platform. Cuddles uses cookies to identify your browser as you visit our websites or those within our social or media network. You may, at any time, disable cookies on your browser. However, disabling cookies will limit your browsing experience and may affect your ability to access certain functions and features and services provided by Cuddles. Cookies also allow Cuddles to provide more relevant, targeted content as you travel through sites in our network as appropriate. 
  6. In addition to the information set out above, Cuddles may record the audio and video for tele-counselling sessions that may be conducted with nutritionists, employees, or any other individual consultants as may be engaged by Cuddles.

Why do we collect information?

  1. Cuddles will only process your personal information for legitimate purposes, however, the purpose for which Cuddles collects your personal information varies in each case. Generally, when you submit your personal information to Cuddles, we collect your personal information for the purposes as outlined below:
    • To send you information pertaining to the Platform and with respect to your use of the Cuddles services through e-mail, and instant messaging;
    • To send you messages and e-mails carrying promotional materials about our programs, projects, and activities;
    • Information for analytical purposes, to improve our website, our donor base, our outreach, our nutrition services or to respond to requests for information or merchandise;
    • For recruitment purposes;
    • To process queries and grievances raised by you against Cuddles and/or the Platform; 
    • To comply with our legal and regulatory obligations, to comply with court orders, relevant tax, payments and other authorities and to exercise Cuddles’ legal rights; and, or, 
    • For any other purpose to the extent necessary to meet any obligation towards you or a third-party.
  2. us; If you are a potential donor/ donor on the Platform, we collect the personal information listed at paragraph 4 above for the purpose of validating you as a donor on the Platform and for to process your donations, requests, or respond to inquiries.
  3. If you are the lawful guardian of the beneficiary of the nutrition and related programmes provided by Cuddles, we collect personal information pertaining to your ward and you, as set out at paragraphs 5 and 6 above, to (or for the purpose of, as applicable): 
    • Provide benefits to the patient under the relevant Cuddles programme;
    • Provide you with updates, reports, and any information pursuant to provision of our services;
    • Contact you to ensure that the patient gets appropriate nutritional advice and support even when the patient is away from the hospital, in between treatment dates;
    • Monitor and evaluate the efficacy of our programme;
    • Impact assessment;
    • Donor reporting and fundraising activities;
    • Train our nutritionists;
    • Update your data and the patient’s data on our records to ensure its accuracy; and
    • Research and for statistical analysis  
    • Provide the patient with treatment;
    • Mainten records;
    • Provide training;
    • Monitoring;
    • Tracking and evaluating effectiveness of intervention;
    • Statistical analysis, research and case studies and publication of materials related thereto;
    • Preparing and publishing write ups such as Success Stories and Parent Testimonials;
    • Preparing donor reports;
    • Seeking donations for nutritional intervention; and, or,

Disclosure to third parties in an aggregated or non-personally identifiable (anonymous) form in furtherance of any of the purposes mentioned above.

With whom do we share your personal information?

  1. We do not trade, share, or sell information that you provide to us with other organisations who intend to use it only to market their products or services to you. 
  2. The purpose for which Cuddles shares your personal information with third parties varies in each case and depends on the purpose for which you provide us with such personal information. Generally, when you submit your personal information to Cuddles, we may disclose it for the purposes as outlined below:
    • With courts, tribunals, legal bodies, regulatory authorities, government entities, and any third-parties, to the limited extent required to provide you with our services and, or, meet a legal or regulatory obligation;
    • With limited third-party service providers including inter alia IT providers, services providers, vendors, agents cloud services, app services, logistics services, website management, e-mail delivery, auditing, and other similar services in order to provide and maintain the provision of the services. Cuddles endeavours to ensure that such service providers adhere to a similar data protection and security framework that Cuddles has presented, and you have agreed to in this Privacy Policy. However, Cuddles will not be liable for the privacy practices of such third-party entities.
    • Where Cuddles reasonably believes that there exists the need to disclose your personal data for satisfying any applicable law, regulation, order, governmental request, or legal process or enforcing any other legal right or claim; 
    • Businesses that are legally part of the same group or that become part of that group, to meet the purpose set out herein;
    • Auditors, accountants, lawyers and other professional advisers to the extent that they require access to the information in order to advise us; and
    • In the event where there is any restructuring, reorganization, merger or sale, or any other form of transfer of assets, Cuddles will transfer your information to the third-party so involved in the transaction, only subject to an agreement by the other party in respect to your information, to process and store your information in a manner which is consistent with this Privacy Policy.
  3. If you are a donor on the Platform, we may additionally share your personal information with others for the following purposes:
    • In conjunction with your sponsorship of a certain project, as required by applicable Indian law; and
    • To facilitate your visit to a partner hospital, if you make such a request.
  4. If you are the lawful guardian of the beneficiary of the nutrition and related programmes provided by Cuddles, we may additionally share your personal information and the personal information of your ward with others for the purposes outlined below. We appreciate that the personal information of your ward is a sensitive subject matter and therefore ensure that the access levels determined by Cuddles allow only such nature of personal information to be viewed by and shared with any third party, as is necessary to meet the purpose for which it was provided:
    • With the doctors, nutritionists, and our employees including patient support co-ordinators and managers of the Cuddles programmes, for the purposes of assistance in treatment of the patient. The access to health data of the patients is closely monitored and the access levels for the doctors, nutritionists, patient support co-ordinators and managers of the Cuddles programmes vary based on their role, qualification, and need to know the information to fulfil the purpose;
    • With our donors and partners for the purpose of providing the patient with benefits under the programmes. Only limited information such as name, photograph, cancer type etc. is shared with donors and partners; and
    • In an anonymous or pseudonymous form with third parties for the purpose of research and statistical analysis and to better our programs.

Our commitment to data security

  1. Cuddles implements reasonable technical, organizational, logical, physical, administrative measures to protect your personal data against any unauthorized access, modification, or, use, including the ISO and, or IEC 27001 standard. We conduct regular security audits by both internal teams and external third-party auditors.

Your rights and your choices

  1. You have the right to access, review or update your information, or request for erasure or correction of your personal data, or withdraw your consent and restrict Cuddles from processing your personal data, by submitting a written request to Cuddles. We reserve the right to refuse your request to the extent permitted at applicable law, upon informing you of the reasons for doing so.
  2. You acknowledge that deletion of all or some of your personal data may result in Cuddles being unable to provide you with services, updates, and disablement of your access to the Platform. 

Data Retention

  1. We are committed to only keeping your personal data for as long as we need to in order to fulfil the relevant purpose (s) it was collected for, as set out above in this notice, and for as long as we are required or permitted to keep it by law.

Changes to this privacy statement

  1. This Privacy Policy may be changed at any time, and while Cuddles will inform you of any changes in the Privacy Policy via a notification or e-mail, we encourage you to periodically visit and review this Privacy Policy.
